Terms of service
These terms govern use of Backsight (backsight.ca). By creating an account you agree to them.
The service
Backsight provides browser-based surveying software: CAD drafting, point management, surfaces, alignments, imagery, point clouds and utility locate reporting. We work to keep the service available and your data intact, including row-level security, immutable originals and checksummed outputs.
Subscription and billing
The service is billed at $99 CAD per month per organization, through Stripe, month to month. You can cancel at any time from your billing page; access continues to the end of the paid period. Prices may change with at least 30 days’ notice.
Professional responsibility and verification
Backsight is a tool for qualified professionals, not a substitute for one. You are solely responsible for verifying every output before relying on it or delivering it, coordinates, transformations, surfaces, volumes, alignments, drawings, processed imagery, point-cloud derivatives and reports alike. You are expected to double-check results against independent knowledge, field evidence and your professional judgment, exactly as you would check any calculation before sealing work. The software reports its methods, accuracies and reproducibility ids precisely so that this review is possible; performing it is your obligation, and nothing in the service relieves you of any statutory, regulatory or professional-association requirement that applies to your work.
Assumption of risk and responsibility for outcomes
By using the service you accept full responsibility and liability for the work you produce with it, including outcomes arising from your own errors and from any defect, inaccuracy, interruption or limitation of the software. If an output is wrong, for any reason, including a fault in Backsight itself, and you rely on it without the verification described above, the consequences are yours. You agree to indemnify and hold Backsight harmless from claims by your clients or third parties arising from work products you created, issued or delivered using the service.
No warranty
The service is provided “as is” and “as available”, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose or engagement, accuracy of results, or uninterrupted availability. No advice or information obtained from the service or from us creates any warranty.
Limitation of liability
To the maximum extent permitted by applicable law, Backsight shall not be liable for any indirect, incidental, special, consequential or exemplary damages, nor for lost profits, lost data, professional discipline, project delay or business interruption, however caused and on any theory of liability. Our total aggregate liability for all claims arising out of or relating to the service is limited to the subscription fees you paid in the three months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions; in those, our liability is limited to the smallest amount the law permits.
Acceptable use
No attempts to breach other organizations’ data, disrupt the service, or resell access. Accounts doing so may be suspended.
Governing law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, and disputes are subject to the courts of British Columbia.
